Limitation of liability and disclaimer for the services provided by Food Experts S.L.

The use of the website www.food-experts.com implies the full acceptance of all of the conditions described below.

By using the services of Food Experts S.L. (hereinafter FEXP), including the use of the website www.food-experts.com, you are accepting the terms and conditions of this Contract in its entirety. If you do not accept all of the terms you must immediately cease using the services of FEXP and eliminate any passwords or other means of validation used for access to the said services.

Contents and accuracy of information. MRLs and analytic results

The information and content of this website may be modified, eliminated or substituted without prior notice.

FEXP accepts no liability whatsoever for the accuracy, updating or appropriateness of the content and information provided at www.food-expert.com or on any of the websites directly or indirectly linked to thereto. This disclaimer includes, but is not limited to, the following:

• MRL and ArfD. The International Regulations on Maximum Residue Limits (MRLs) and Acute Reference Doses (ArfD) are subject to many changes that could result in the information provided by FEXP not being fully up to date. YOU accept that the above limits are only a first reference and may contain errors.
• Information uploaded into the system by customers, third parties and agents, including laboratories and sample takers. The participating agents in the FEXP System are solely and exclusively liable for all information uploaded or omitted. In FEXP assumes no liability whatsoever for any incorrect presentation of the service resulting from the falsity, failure to deliver, or omission of relevant information.
• Samples. The accuracy of the information provided from the samples taken and the identification thereof.
• Analytical results. The accuracy of the results provided is the exclusive liability of the laboratory performing the analysis.

Custody and transfer of information

The transmission of data and information over the Internet implies certain risks. Do not send any information using programs that do not have the appropriate level of security or encryption.

FEXP has taken measures to ensure that all information sent is safe and virus free, but cannot fully guarantee it and therefore assumes no liability therefor. The Customer is responsible for assuring that the e-mails and information received from FEXP and its suppliers are safe and free of any computer virus.

FEXP has taken measures to assure that confidential information is protected and only accessible to authorised personnel. The foregoing notwithstanding, FEXP accepts no liability for any losses or damage as may result from access to confidential information by third parties or unauthorised personnel, including any malicious actions by computer experts (hackers), or any errors in the functioning or programming of the database.

FEXP assumes no liability whatsoever for the use of confidential information by third parties for which you have granted access to analytical results or other types of confidential information.

Limitation of liability

FEXP is solely and exclusively liable for the damage resulting from any malicious or criminal acts or grave negligence.

In no case shall FEXP be considered as liable for any costs incurred during the provision of the service or for any loss of profits, information, data, or for any other special loss or damage incurred directly or indirectly, by chance or on purpose, derived in any way from the sale, use, and impossibility of the use of a product or service provided by FEXP, regardless of whether FEXP has been notified of the possibility of such loss or damage. The liability of FEXP and its suppliers shall be limited in all cases to the amount indicated in the section on compensation.

FEXP shall not be liable for any loss, damage, cost, or any other claim derived from any incomplete, incorrect, late or missing instructions or communications sent by YOU when it is the result of causes beyond the control of FEXP.

FEXP shall not be liable for any failure to comply with its obligations due, directly or indirectly, to causes of force majeure, understood to mean any event or situation beyond the will of FEXP which cannot be foreseen, or being foreseeable, is unavoidable and beyond the control and influence of FEXP.

FEXP assumes no liability for any loss or damage as may result from the use of its software on the computers of YOUR employees. YOU are liable for having appropriate insurance to cover any such damage to computers and the information stored on the computers.

Compensation

Except in the case of personal injury (including death) resulting from malicious or criminal acts or grave negligence, the total liability of FEXP and the only compensation to which the customer has any right shall be limited to the total amount paid by the customer to FEXP over the last 12 months for the services provided.

If any of the clauses or provision of this contract are declared void or invalid, the remaining clauses and provisions shall remain in full force and effect.
